By using the Services or providing us with your personal information, you agree to the collection, use, and disclosure of your information as described in this policy. If you do not agree, please do not use our Services.

When we do, we will update the "Last updated" date at the top of this page and take any other steps required by applicable law. We encourage you to review this policy periodically.

The Privacy Act 1988 (Cth) defines personal information as information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether true or not, and whether recorded in a material form or not.

Information that does not identify you or enable your identity to be reasonably ascertained will generally not be treated as personal information under this policy.

Information you provide directly

When you interact with our Services, you may provide us with:

  • Order information — billing and shipping address, payment confirmation (payment card details are processed by our payment processor and are not stored by us)

  • Website platform and hosting — our website is hosted on Shopify Inc. (Canada). Shopify processes certain data on our behalf to operate the site. Shopify's privacy practices are set out at shopify.com/legal/privacy
  • Website analytics — we use Google Analytics 4 and Google Tag Manager (Google LLC, United States) to understand how visitors use our website
  • Social media platforms — when you interact with us on Facebook, Instagram, TikTok, or YouTube, those platforms process data in accordance with their own privacy policies
  • Payment processors — payment card information is collected and processed directly by our payment processor and is not stored by Tackle World
  • Competition and prize administration service providers, where applicable
  • Professional advisors including lawyers, accountants, and auditors, on a confidential basis
  • Law enforcement agencies or government bodies where required or authorized by Australian law
  • We do not sell your personal information to third parties.

7. Cookies and Tracking Technologies

Our website uses cookies and similar tracking technologies. A cookie is a small text file stored on your device when you visit a website.

We use the following categories of cookies:

  • Strictly necessary cookies — required for the website to function, including Shopify session and security cookies
  • Analytics cookies — used to understand how visitors interact with our website (Google Analytics 4, Google Tag Manager)

8. Overseas Disclosure

Some of the third-party service providers we use to operate our website and deliver our services are located outside Australia. By using our Services, you acknowledge that your personal information may be transferred to and processed in overseas countries, including:

  • United States of America — Klaviyo, Inc. (email marketing); Google LLC (analytics); Meta Platforms, Inc. (Facebook, Instagram); TikTok Inc.
  • Canada — Shopify Inc. (website platform and hosting)

We take reasonable steps to ensure that overseas recipients handle your personal information in a manner consistent with the Australian Privacy Principles. However, overseas recipients may be subject to the privacy laws of their own country, which may differ from Australian law. In some cases, those laws may not offer the same level of protection as the APPs, and we may not be able to take steps to ensure overseas recipients comply with the APPs.

By using our Services and providing us with your personal information, you consent to this overseas transfer in accordance with APP 8.2(a) of the Privacy Act 1988 (Cth).

9. Direct Marketing and Email Communications

We send marketing emails and our newsletter only to subscribers who have expressly opted in to receive them. We use Klaviyo, Inc. to manage our subscriber list and send these communications.

Every marketing email we send includes a functional unsubscribe link. You can opt out at any time by:

  • Clicking the "Unsubscribe" link at the bottom of any marketing email
  • Emailing us at support@tackleworld.com.au with your request

We will action unsubscribe requests promptly. If you unsubscribe, we will retain your email address on a suppression list to ensure we do not contact you again.

Please note that opting out of marketing emails does not affect any transactional communications we may need to send (for example, in connection with a competition prize).

10. Data Security

We take reasonable steps to protect the personal information we hold from misuse, interference, loss, and unauthorised access, modification, or disclosure. Our measures include:

  • Using reputable third-party platforms with industry-standard security (Shopify, Klaviyo)
  • Encrypted password storage
  • Restricting access to personal information to staff and contractors with a legitimate need
  • Regular review of our data handling practices

Despite these measures, no data transmission or electronic storage system is completely secure. We cannot guarantee the absolute security of your personal information.

11. Data Retention

We retain personal information only for as long as necessary for the purposes for which it was collected, or as required or permitted by law. As a general guide:

  • Email subscriber data — retained while your subscription is active. Unsubscribed contacts are retained on a suppression list to honour your opt-out, then de-identified or deleted when no longer required
  • Competition entry data — retained for the period required to administer the promotion and fulfil prizes, and for any applicable regulatory period, then deleted
  • Website analytics data — subject to Google Analytics 4 retention settings (currently 14 months)
  • Business records that may contain personal information — retained for 7 years in accordance with accounting and legal obligations

When we no longer need personal information, we will take reasonable steps to destroy it or de-identify it in accordance with APP 11.

12. Automated Decision-Making

We use automated processing as part of our marketing activities, including:

  • Automated email segmentation and flow triggers via Klaviyo, which determine which subscribers receive particular communications based on engagement behaviour, location, and preferences
  • Website analytics tools that automatically process browsing behaviour to generate aggregated reports

These automated processes influence, but do not solely determine, decisions about which marketing communications you receive. You may contact us using the details in Section 14 if you have questions about how automated processing affects you.

We will update this section to reflect the requirements of the Privacy and Other Legislation Amendment Act 2024 (Cth) regarding automated decision-making disclosure as required by the applicable compliance deadline.

13. Your Rights

Under the Privacy Act 1988 (Cth) and the Australian Privacy Principles, you have the following rights:

  • Right to access — you may request access to the personal information we hold about you (APP 12)
  • Right to correction — you may ask us to correct personal information that is inaccurate, out of date, incomplete, irrelevant, or misleading (APP 13)
  • Right to opt out of direct marketing — you may withdraw consent to receive marketing communications at any time (see Section 9)
  • Right to make a complaint — you may complain about how we have handled your personal information (see Section 14)

To exercise any of these rights, please contact us using the details in Section 14. We may need to verify your identity before actioning your request. We will respond within a reasonable timeframe (generally within 30 days).

We will not charge you for making an access or correction request, although we may charge a reasonable fee if the work involved in providing access is substantial.
